Barnsley's official club web site confirmed the decision, and it brings to an end a dispute over the midfielder's transfer which was finalised on June 2, but Barnsley later confirmed the deal had been done on April 29 - the day before Kell broke his leg in a 4-0 thrashing of Bristol Rovers.

"Scunthorpe are alleging we made an approach to the player before we should have done but we didn't approach the player direct, we approached his agent," said a Barnsley spokesman earlier this week.

The Yorkshire club had even appointed former FA compliance officer Graham Bean's Football Factors to defend the Reds.

As Iron fans may remember, ex-United associate director Bean was unsuccessful in May 2004 when he was the figurehead of a seven-man consortium aiming to take over the club.
